If you can't get out of bed, the case starts with a phone call

If you are reading this from a bed at Sarasota Memorial Hospital Venice on Laurel Road East, or from home with a walker within reach, and driving anywhere is weeks away, that is fine. Nothing about starting a claim requires you to come to Venetia Bay Boulevard first.

On the first call, David asks what happened and where: the road, the time of day, which way the driver was coming from. He asks which agency wrote the report, which hospital you were taken to, and whether any insurer has already called you. Then he explains, in plain words, what he sees and what happens next while you recover.

If you are the son or daughter making this call from the hallway outside a room at SMH Venice, you can start it. Tell David what you know and what you don't. He will want to hear from your parent when they are able, because the claim is theirs, but the questions about the report and the deadlines can begin with you.

If it is easier to have someone hold the phone for you, that works too. Call 941-499-1400 when you are ready.

Hit while walking in Nokomis: your first two weeks

Most of what you read online assumes you were behind a wheel. Here is the usual order of things when a driver pulling out hits someone walking along Albee Road, beside US-41 through Nokomis, near Laurel Road, or at a Legacy Trail crossing.

  1. The day of the crash. Depending on where it happened, the report comes from the Sarasota County Sheriff's Office, the Venice Police Department or the Florida Highway Patrol. For the first 60 days, Florida releases it only to the people involved, their lawyers, their insurers and a few others, through the FLHSMV Florida Crash Portal.
  2. The hospital. Many people hurt in Nokomis are taken to Sarasota Memorial Hospital Venice. The most serious injuries go to the main Sarasota Memorial campus on South Tamiami Trail in Sarasota.
  3. The 14 days. Florida ties PIP benefits to treatment that begins within 14 days of the crash. Your time at SMH Venice is part of that record, so keep every discharge page and appointment card.
  4. The insurer's first call. An adjuster for the driver may call while you are still admitted. You can say you will call back after you have spoken with a lawyer.
  5. Fault at dusk. Expect questions about what you were wearing, where you were walking and how light it was. Florida uses modified comparative : if you are found more than 50 percent at , you recover nothing, and at 50 percent or less your recovery is reduced by your share. A driver pulling out has duties to people on foot too, and David looks early at how the light, the shoulder and the driveway lined up.

There is a longer guide to what to do in the first days, written for drivers but useful for anyone hurt on a Florida road.

When you are ready to come in

From Nokomis, it is US-41 to Venetia Bay Boulevard, about 4 minutes. From the island, take West Venice Avenue to US-41, about 6 minutes. From Venice Gardens, South Venice, Englewood or North Port, the US-41 Bypass carries you most of the way.

Look for Suite 223. Another office shares the building, and online maps put both on the same pin, so the suite number is the thing to watch for. The Directions link in the office block above opens the Venice office itself on Google Maps, not the middle of town.

If getting from the car to the door is the hard part right now, ask David about it when you call. Coming in is never what starts the case.

Who you will meet in Suite 223

David Harris. He takes the first call, he handles the case, and he is the lawyer you sit down with on Venetia Bay Boulevard. One lawyer, start to finish.

That matters most in the weeks when you cannot keep track of much. If anyone else will be part of your file, David will tell you who and why.

What to bring, or send ahead

Bring these if you come in, or photograph them and send them from your phone:

  • The crash report number, or the name of the agency that responded
  • Your health insurance card, and any auto policy in your household
  • Photos of where it happened, your injuries, and your clothing if you kept it
  • Hospital and discharge papers from SMH Venice or wherever you were treated
  • Letters, emails or voicemails from any insurer
  • The names of any witnesses

Have only half of this? Call 941-499-1400 anyway. The list is for later. The call is for now.

Other crashes this office handles

Car crashes on the US-41 Bypass and Venice Avenue

Left turns across the Bypass, sudden stops at East Venice Avenue, and the rear-end crashes that follow when season traffic backs up at the lights. David handles car accident claims from a sore neck to a life-changing injury, and rear-end crashes have their own page.

Box trucks and delivery vans on US-41

Delivery vans and box trucks work US-41 through Nokomis and South Venice all day, stopping, turning and backing out of lots. When a commercial vehicle hits you, there may be a company policy as well as the driver's, and company records that are worth asking for early. Read more about work trucks and vans.

Motorcycles on I-75 between Laurel Road and River Road

The stretch of I-75 from the Laurel Road interchange past Jacaranda Boulevard to River Road is fast, and lane changes there catch riders. Florida PIP generally does not cover someone riding a motorcycle, so the path for medical bills looks different from a car case. See how David handles motorcycle crashes.

Florida's deadlines in one place

  • PIP pays first. Florida is a no-fault state. pays first, up to $10,000, no matter who caused the crash.
  • 14 days. Treatment must begin within 14 days of the crash to keep PIP benefits.
  • Two years. For claims from crashes after March 24, 2023, the limit is two years. If your crash was earlier, talk to a lawyer about your date. Here is more on how long you have to file.
  • The 51 percent bar. More than 50 percent at means no recovery from the other side.
  • Uninsured motorist coverage. When the driver who hit you has little or no coverage, uninsured and underinsured motorist coverage is often where the claim goes next.

None of these dates waits for you to feel better. A call to 941-499-1400 tells you where each of them stands for your crash.

I was put at ease from the beginning and all along the way. This was important to me since I had no similar experience to draw on. David's prompt telephone, text and email contacts and responses were always timely and detailed. I highly recommend this firm

Questions about the Venice office

Is the Venice office the one that handles Nokomis?

Yes. Suite 223 on Venetia Bay Boulevard is the firm's office for Nokomis, Laurel, Venice and the south county, about 4 minutes from Nokomis by US-41. The Sarasota office on Potter Park Drive serves Sarasota. Either way, the first call is with David Harris. Florida's 14-day window for PIP treatment starts on the day of the crash, so call 941-499-1400 while those first days still count.

I can't get out of bed. Can David come to me, or do we do this by phone?

Start by phone. What a claim needs at the beginning, the crash report, the hospital records and the names of the insurers, can be gathered while you stay where you are. On that first call David explains what happens next and what, if anything, you need to do while you recover. Florida's two-year limit for claims from crashes after March 24, 2023 does not pause while you heal, so call 941-499-1400 from the bed.

How long does it take to get to your office from the island?

About 6 minutes in light traffic: West Venice Avenue off the island to US-41, then up to Venetia Bay Boulevard. In season, give it longer. You do not need to make that drive to start a claim, though. PIP benefits depend on treatment starting within 14 days of the crash, so the useful first step is a call to 941-499-1400, not a trip across the bridge.

I was walking and I don't have car insurance. Who pays my hospital bill?

If you own no car, whose PIP covers you depends on the auto policies in your household, if there are any, and David answers that on the first call. Past PIP, the next question is the coverage of the driver who hit you. Keep every bill and discharge paper from SMH Venice, and call 941-499-1400 before an insurer tells you nobody covers you.

My daughter wants to make the call for me. Is that okay?

Yes. A daughter, son or spouse can make the first call and tell David what they know: where it happened, which agency responded, which hospital you are in, and which insurers have called. David will want to speak with you when you are able, because the claim is yours. Florida's 14-day PIP window and the two-year filing limit both run from the date of the crash, so have them call 941-499-1400 early.

What happens when you call 941-499-1400

You reach David Harris Law in Venice, and the conversation is with David Harris.

  1. You tell David what happened, where and when, in your own words.
  2. He asks about the crash report, the hospital and any insurer who has called you.
  3. He tells you which insurance he expects to look at first.
  4. He checks your dates against the 14-day PIP window and the two-year filing limit.
  5. He explains what he would do next and what, if anything, you need to do.
  6. You decide whether to go forward. Nothing has to be decided on that call.
